Terms of Service

ShortsHQ is operated by Taciturn Studios LLC.

1. Acceptance of Terms

By creating an account or using ShortsHQ ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including trial and paid subscribers.

2. Description of Service

ShortsHQ is an AI-powered platform that generates short-form video campaigns from URLs, brand assets, and user inputs. The Service includes campaign creation, voice generation, trending topic analysis, and publishing tools.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 13 years old (or 16 in the EU/UK) to create an account.

4. Subscriptions and Billing

New accounts get a 3-day trial with no credit card. There is no permanent free plan. Paid plans are billed monthly or yearly via Stripe. Yearly billing is 20% off. By subscribing, you authorize us to charge your payment method each period until you cancel.

Cancellations take effect at the end of the current billing period. You retain access to paid features until that date. Refunds are governed by our Refund Policy.

5. Acceptable Use

You agree not to use ShortsHQ to:

• Generate content that is illegal, defamatory, harassing, or violates third-party rights.
• Produce deepfakes or synthetic media intended to deceive or defraud.
• Infringe intellectual property rights (copyright, trademark, trade secrets).
• Circumvent plan usage limits through automation, bots, or shared accounts.
• Resell or sublicense the Service without written permission.
• Interfere with the platform's infrastructure or security.

6. Content Ownership

You retain ownership of all content you upload to ShortsHQ (brand assets, logos, scripts). You grant ShortsHQ a limited, non-exclusive license to process and store your content solely to provide the Service.

AI-generated content produced by ShortsHQ using your inputs is owned by you, subject to applicable law. You are solely responsible for ensuring generated content does not infringe third-party rights before publishing.

7. AI Disclaimer

ShortsHQ uses large language models and AI services to generate content. AI-generated content may contain errors, inaccuracies, or unintended outputs. You are responsible for reviewing all AI-generated content before publishing. ShortsHQ makes no warranties regarding the accuracy, legality, or fitness of AI-generated outputs.

8. AI Chat Services

Certain features of the Service, including but not limited to our chat assistant, are powered by artificial intelligence. By using these features, you acknowledge that:

• (a) Responses are generated by AI and may not always be accurate, complete, or current.
• (b) Your inputs may be recorded and used for service improvement and AI model training.
• (c) You should not share sensitive personal information (financial data, health records, passwords) through the AI chat.
• (d) AI chat responses do not constitute professional advice of any kind.

A consent notice is displayed before your first chat interaction. By clicking "I Understand — Start Chat," you expressly consent to the recording and processing of your chat messages as described in our Privacy Policy.

9. Intellectual Property

The ShortsHQ platform, brand, and all proprietary technology are owned by ShortsHQ and protected by intellectual property law. You may not copy, modify, or reverse-engineer any part of the platform.

10. Limitation of Liability

To the maximum extent permitted by law, ShortsHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your account at any time from the Billing page. Upon termination, your data will be deleted within 30 days.

12. Governing Law

These Terms are governed by the laws of the State of California and the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.

Third-party platforms

ShortsHQ's YouTube features use YouTube API Services. By using them, you agree to be bound by the YouTube Terms of Service and acknowledge the Google Privacy Policy. ShortsHQ's TikTok features are subject to TikTok's Terms of Service. You are responsible for the content you post and for following each platform's rules. You can disconnect a channel at any time, which revokes the stored token. The Privacy Policy describes what YouTube and TikTok data we store.

Until Google and TikTok finish reviewing ShortsHQ's apps, videos posted through ShortsHQ stay private on the destination account.
